PRICES:
All prices in our catalog are subject to change without notice. Quoted price does not include shipping and handling, fit up, installation or additional labor other than that of manufacturing. Minimum order is $25.00 (M.E.S. t-shirts are available to fill your order.)
SHIPPING INSTRUCTIONS:
Customers should provide specific shipping instructions. If this information is not provided, we will use our own judgment in selecting route. The customer is responsible for payment of transportation, delivery, insurance, any duties and taxes, federal and state charges where applicable. The cost of handling will be done at cost, F.O.B. Riviera Beach, Florida.
RETURNED GOODS POLICY:
We want you to be happy with your purchase, so we guarantee every item that we sell. If you wish to make an exchange or return your order (except for custom orders, silicone hose or fiberglass tubing cut to length, and installed or used items), please phone for a return authorization number prior to shipping. A copy of the original invoice must accompany all returns. Credit will be issued only upon inspection of returned goods condition. A 20% restocking fee may apply to returns other than a defective product.
DAMAGE IN TRANSIT:
Our packing is expertly done with consideration given to type of article and carrier. Should damage occur, please note the details on the freight bill and immediately file proper claim with Transportation Company. Damage in transit is the responsibility of the carrier. Claims filed against the carrier are the responsibility of the customer.
WARRANTY ON DISTRIBUTED PRODUCTS: All of our distributed products have been proven and tested to be the best available in the market. If an incident occurs on any of the products not manufactured by Marine Exhaust Systems, Inc. are directly warranted by the manufacturer. A copy of each manufacturer's warranty is available upon request. As a distributor, we assume no liability for the use of any item not of our manufacture, and offer no warranty, either expressed or implied, for such products. Any failure of a product purchased through our company should be directed to our Customer Service Dept. who will assist in your claim. Please note that acceptance of such items by our company for submission to the manufacturer does not imply validity to any claim. All decisions regarding the repair or replacement of any items are the sole responsibility of the manufacturer. As a distributor, we have no authority to replace a defective item prior to submitting such item to the manufacturer.

MANUFACTURED PRODUCTS:
Marine Exhaust Systems, Inc. warrants that all exhaust parts to be provided to Purchaser hereunder will be of excellent quality and workmanship, and Marine Exhaust Systems, Inc. will replace or repair at M.E.S.'s descretion such parts within the times from the date of purchase as follows:

Dry Sections - five (5) years;
Metal Flex Sections - one (1) year;
Liquid Cooled Sections - two (2) years;
High Temperature Hard coated Insulations - two (2) years;
High Temperature Soft Covers - one (1) year;
Fiberglass mufflers - two (2) years.

*The exhaust riser/elbow water injection can should have a minimum of 15° down angle or more.
Replacement of the foregoing parts is contingent on Purchaser notifying Marine Exhaust Systems, Inc. in writing or by delivery of said parts to the Shipping Point, within twenty-one (21) days of any manifestation of defect. Purchaser shall be responsible for delivering, at Purchaser's cost, defective parts and items to the Shipping Point for repairs. Return for replacement or repair shall not extend the warranty period.

EXCLUSIONS:
The above warranties will not apply to

1.Haul-out, launching, towing, storage or rental charges, loss of use, inconvience, etc.
2.Removal or reinstallation.
3.Incidental or consequential damages.
4.Misused, abused, altered, or improperly installed or supported equipment, including, but not limited to excessive torquing of hose clamps; the burning of any fiberglass exhaust part due to lack of cooling; or damage caused by improper cooling of the exhaust parts.
5.The above warranty is void with respect to metallic exhaust parts that are installed on watercraft which are galvanically annolized and found to have .85 volts negative electrical potential.
DISCLAIMER OF WARRANTY:
There are no other warranties, express or implied, other than that stated above.

REMEDY AND LIMITATION OF REMEDY AND LIABILITY:
Marine Exhaust's sole liability shall be repair or replace, at its facility, any defective part appearing or manifesting itself within the Warranty Period without cost to the owner. Owner shall be responsible for delivering the exhaust part(s) to MARINE EXHAUST SYSTEMS, INC. for such repair. This remedy shall be the exclusive remedy for breach of any warranty under this contract and for any defect or damage caused by or attributable to any action or inaction by MARINE EXHAUST SYSTEMS, INC., its officers, special agents or employees. Owner shall not be entitled to recover consequential damages from MARINE EXHAUST SYSTEMS, INC. for breach of any warranty or duty arising from this contract, or otherwise.

The materials remain the property of MARINE EXHAUST SYSTEMS, INC. until the invoice is fully paid. In case of default and this account is placed with a collection agency for collection of the unpaid balance, the Agent / Owner will be responsible for the cost of collection (33 1/3 %) of the principle balance, plus interest at the rate of 1.5% per month and any State or Federal taxes.

In the event this account is placed in the hands of an Attorney for collection or litigation, the Agent / Owner will be responsible for pre and post collections fees including interest, filing fees, court costs, Attorney's fees, process server fees, Marshal fees and substitute custodian fees.
